General terms and conditions of sale

We are confident that this purchase agreement will go through without any problems. Nevertheless, we are legally compelled to agree on a number of terms together and have them confirmed by the buyer.

These terms and conditions are agreed upon between:

Piano’s Maene Netherlands B.V., Robijnstraat 5, 1812 RB Alkmaar, (KVK-number: 37059323) and any natural or legal person who makes a purchase on the website of Piano's Maene (www.maene.nl), hereafter referred to as "customer" or "buyer".

 

Article 1 - Application

The purchase of any good or service through this site implies acceptance by the purchaser of these conditions of sale. Piano's Maene reserves the right to modify these conditions of sale at any time. The conditions that are valid on the day of the order are legally binding.

Article 2 - Specified specifications of the goods or services

The products and services offered are those listed in the catalog published on the site www.maene.be. These products and services are offered within the limits of available stocks. Pianos Maene is not responsible for printing errors, incorrect spelling or product specifications and changes to articles published on the website. Product images are indicative only.  All prices are expressed in euro and include all legal contributions. Prices and offers are only valid for a certain period and can change without prior consent. Any change in the VAT rate will affect the price of the products or services concerned. Pianos Maene makes an effort to present all information as completely and correctly as possible, but does not accept any responsibility for damage which is caused by incorrect or incomplete information.

Article 3 - Delivery time and delivery

3.1 Acoustic piano or grand piano

When ordering an acoustic piano or grand piano via the webshop, a Piano’s Maene representative will contact the buyer by phone on the next working day to schedule the delivery date. For the delivery of an acoustic instrument, we use our own transport service or a specialized transport company with which we structurally collaborate. The delivery time of the purchased instrument may vary and depends on its location at that moment (our showroom, our warehouse, or the supplier’s warehouse). The day before delivery, you will receive an email with an indication of the delivery time window and a "track & trace" link to follow the progress of the delivery. Our transporters place the piano or grand piano in the location you indicate, on the ground floor (if no specific mention is made at the time of ordering, we assume that delivery must take place on the ground floor). Deliveries to upper floors may incur additional charges. Upon delivery, a signature for receipt is required. Any remarks can be noted on the delivery documents.

3.2 Digital piano

Digital pianos are delivered by default in their original packaging via the transport company GLS. When placing the order, the customer selects an available delivery date. Delivery takes place on a pallet to the delivery address. The driver places the instrument inside the building, beyond the threshold, on the ground floor. Deliveries to upper floors are not included; the instrument will not be carried upstairs. The transport company informs the customer in advance by email once the shipment is on its way.

The customer may optionally choose the Premium Transport Service. In this case, the instrument is assembled on site by GLS and set up ready to play. The packaging materials are taken back and processed. Heavier or larger digital cabinet pianos are, in most cases, pre-assembled and delivered by the Piano’s Maene transport team.

Lighter digital stage pianos are shipped via the GLS parcel service. Shipment generally takes place on the next working day after receipt of the order, provided the product is in stock. For these instruments, it is not possible to select a specific delivery date.

3.3 Accessories

Accessories ordered separately (without the simultaneous purchase of a piano) are delivered via the GLS parcel service. It is not possible to select a specific delivery date.

3.4 General

In case of permanent unavailability, Pianos Maene will offer a replacement product to the purchaser. If the purchaser is not interested in the proposed product, the amount already paid will be reimbursed by bank transfer.

The given delivery time is indicative, any delays due to force majeure or circumstances attributable to the customer, can never oblige Piano's Maene to pay any compensation, nor be a cause for refusal of delivery.   Any delay in delivery of which Piano's Maene would become aware will be communicated to the customer as soon as possible. The risk of the delivered goods passes at the moment of delivery.

All expenses incurred by Piano's Maene within the framework of the execution of the agreement at the request of the customer will be entirely at the expense of the latter, unless parties have explicitly agreed otherwise in writing.

We hebben er alle vertrouwen in dat deze koopovereenkomst zonder problemen zal verlopen. Toch zijn we juridisch genoodzaakt om een aantal voorwaarden samen af te spreken en door de koper te laten bevestigen.

Article 4. Reservation of ownership

All goods delivered will remain the property of Piano's Maene until the customer has fulfilled all obligations of the agreement entered into and until the goods have been paid for in full. Therefore, before full payment of the principal sum, additional interests and costs, the customer is not authorized to pledge, transfer ownership, encumber or in any way place the instruments under the control of third parties. The buyer hereby gives permission, where appropriate, to have the delivered goods repossessed without delay.

Article 5 - Intellectual Property

Our website, logos, texts, pictures, names and in general all our communications are protected by copyrights. This means that you may not copy or reproduce our logo, website, photos, names, texts, color combination, etc. without our prior consent.

Article 6. Complaints

Any complaints concerning the executed goods and/or the invoice must be communicated to Piano's Maene within eight days.  The complaint must be clearly described, so that Piano's Maene can take the necessary steps to resolve the complaint, in case the complaint is founded. Complaints are in no case founded if the customer did not handle the delivered work or good with the normal care that can be expected from him. The formulation of a complaint does not relieve the customer of his contractual payment obligations.  

Article 7. Force Majeure

Under no circumstances can Piano's Maene be held liable to the customer for not fulfilling her obligations in situations of force majeure. Force majeure includes, but is not limited to: weather and climate conditions, lightning strike, flooding, storm, war, riots, strike, industrial action, union or employee disputes, accident, fire, difficulties or increased costs in finding workmen, substances or transportation, or any other circumstances which render the delivery of the goods through the normal supply or production channels difficult or render the delivery of the goods through the normal route or means of transportation difficult. In circumstances of force majeure, Piano's Maene may terminate the agreement or cancel the delivery of goods to the customer, or may, with the agreement of the customer, deliver the goods according to agreed terms after suspending deliveries.

Article 8. Disputes

All agreements between Piano's Maene and its customer are governed by Belgian law.  In case of a dispute, the Court of the judicial district where the registered office of the lessor is situated is competent.

Article 9.  Protection of personal data

The personal details of the purchaser are only used for the processing of the purchase. We will always follow the law which you can find on the website of the Autoriteit Persoonsgegevens.

Article 10. Waiver of purchase

The consumer has, for an online purchase through our webshop, the right to renounce the purchase, without having to pay a fine and without having to state a motive, provided this occurs within thirty calendar days from the day following the delivery of the goods or the conclusion of the service agreement.

Article 11. Price indication, manifest errors and formation of the agreement

11.1 Price indication

All prices on the Piano’s Maene website are expressed in euros and include VAT, unless stated otherwise. Any delivery, transport or installation costs are communicated separately and clearly prior to the confirmation of the order.

11.2 Duty of information and due care 

Piano’s Maene strives to ensure that prices, product information and availability are always displayed correctly and kept up to date. However, manifest errors or technical mistakes cannot be entirely excluded.

11.3 Manifest material errors

 In the event of a clear material error in the price indication (such as an incorrect zero price, an unrealistically low price that clearly does not correspond to the actual value of the product, or a price resulting from a technical malfunction), Piano’s Maene shall not be bound by such incorrect price.

11.4 Right of cancellation 

If an order has been placed on the basis of a manifest pricing error, Piano’s Maene reserves the right to cancel the order, even after an automatic order confirmation has been sent. In such case, the customer will be informed as soon as possible. 

11.5 Refund 

If the customer has already made a payment for an order that is cancelled due to a manifest pricing error, the amount paid will be fully and promptly refunded via the same payment method.

11.6 No automatic formation of agreement

An automatically generated receipt or order confirmation shall not constitute final acceptance of the offer. The agreement is only formed upon explicit confirmation by Piano’s Maene or upon the effective shipment of the product.
